Dealers are famous (infamous?) for not accurately listing cars. I wonder how many people see that "one owner" flag and never bother to look at the CarFax? I'll bet it's a lot. And then when they go to sue 6 months later, the web page is long since gone and they can't prove it ever happened.

In my limited experience with bmw's ccb, they performed fine when cold. YMMV. I still prefer the pedal feel of steel brakes, but with BBW that may not be as large of a factor. I'm still too cheap to get them just to aid in cleaning.
